A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.

The case stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to answer alien smuggling allegations, he was detained in immigration custody.

In her decision, the judge pointed out that the government does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

The court proceedings involve disputed assertions. While the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this allegation.
